Workshop for forwarders named MULTIMODAL CARRIAGES: RISKS AND LIABILITY OF THE PARTIES

XII Annual International Seminar “Ship owner and Insurer: Insurance Payments”

The seminar organized by Remedy Law Firm (Russia) and International Law Offices (Ukraine) was held with the support of Russian State Insurance Company Rosgosstrakh and RESO-Garantia. More than 80 delegates visited the event.

As the global crisis takes on new and more alarming aspects, shipping as the most cost-effective type of transportation increase volumes of import-export operations and facilitate economic progress. Though shipping and insurance are different lines of business, they are interdependent and a proper insurance coverage provides support for successful and cost effective business. The Seminar became a great platform for ship owners, representatives of the shipping and insurance industries, as well as representatives of consulting companies to meet and discuss critical issues and concerns, to find necessary solutions to anticipate problems, to analyze the strategies for keeping the shipping and insurance business profitable.

Football as business


On the 6th of October, 2009, Arthur Nitsevych and Nikolay Melnykov, the partners of “International Law Offices” visited the first international conference Football as Business organized by the Ukrainian agency Sport Agent.

The Conference took place in Opera Hotel in the centre of Kiev.

The organizers invited Ivan Bravo, Director of Strategic Planning Department of FC Real (Madrid) and Sergey Palkin, General Director of FC Shakhtar (Donetsk) but, unfortunately, they were not able to be the speakers there.

The lawyers of International Law Offices, Vyacheslav Lebedev and Nadezhda Malanchiy, took part in theoretical and practical conference held on 10 December 2009 in Odessa National Maritime Academy (ONMA) named “Adaptation Problems of the National Legislation of Ukraine to International Seafarers’ Labour Standards”. There were analyzed the provisions of ILO Maritime Labour Convention dated 23 February 2006 and national legislation of Ukraine. The participants of the conference with a keen interest received reports of the lecturers and postgraduates of the Maritime Law and Management Department (ONMA). The discussions were dedicated to the rules fixed by the abovementioned Convention and their correlation with the rules stipulated by the labour laws of Ukraine.

Partner Olena Losevska joined the team working over the TRACECA TEN-T Project in Ukraine. She was involved into the project as legal assistant. Mrs. Losevska provided the EU Commission with the issues on private investments in Ukrainian ports and PPP viability as well as the prohibitions and difficulties connected with the procedure of implementation of investment. (The details on how to invest in Ukraine ports see in publications directory on the web-site). The contributed investigation is to assist how to establish appropriate funding mechanisms.

Hereby we inform you about a Second Circuit case decided on October 16, 2009, The Shipping Corporation of India Ltd. v. Jaldhi Overseas Pte Ltd., which severely limits the scope of the type of property that may be attached pursuant to Rule B. The Court, in sum and substance, held that “electronic fund transfers (“EFTs”) being processed by an intermediary bank are not property subject to attachment under Rule B.” Since EFTs are no longer considered property of either the originator or the beneficiary, it cannot be “defendant’s property” subject to Rule B attachment.

In September 3, 2009 published an article of Vincent Champion, Editorial Director of WorldCargo News where the comments of legal expert in the field, Arthur A Nitsevych, a partner in International Law Offices,were attracted It’s back to square one in Ilyichevsk, while the drama in Yuzhniy could now play out on 8 September On 26 August Russia's National Container Company (NCC), the owner of UktransContainer (UTC), won its appeal in the third court of instance, the High Court of Appeal in Kiev, against the suspension of UTC's concession and the virtual seizure of the terminal by the Ilyichevsk seaport administration.
